By accessing and using kicktide ("the Platform"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our service.

To use certain features of the Platform, you must register for an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain the security of your account credentials
• Promptly update any changes to your account information
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized account access

For Sellers

When listing pool service routes, you agree to:

• Provide accurate and truthful information about your routes
• Have legal ownership and right to sell the listed accounts
• Respond to buyer inquiries in a timely and professional manner
• Complete the transfer of accounts as agreed upon after sale
• Not list accounts that are already under contract elsewhere

For Buyers

When purchasing pool service routes, you agree to:

• Pay the $400 brokerage fee and fund escrow as required
• Conduct due diligence on listings before purchase
• Complete the transaction process within agreed timeframes
• Confirm receipt of accounts to release funds from escrow

kicktide charges a flat $400 brokerage fee per transaction, paid by the buyer. This fee covers:

• Platform usage and transaction processing
• Customer support throughout the transaction
• Listing verification and moderation

Purchase funds are held securely through Escrow.com, which may charge additional fees according to their fee schedule.

You may not:

• Use the Platform for any illegal purposes
• Post false, misleading, or fraudulent listing information
• Attempt to circumvent the Platform to avoid fees
• Harass, abuse, or harm other users
• Interfere with or disrupt the Platform's operation
• Use automated tools to scrape or collect data from the Platform
• Impersonate another person or entity

The Platform and its content, features, and functionality are owned by kicktide and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works without our express permission.

kicktide is a marketplace platform that connects buyers and sellers. We do not:

• Guarantee the accuracy of listing information
• Verify the financial performance of listed service routes
• Assume responsibility for disputes between buyers and sellers
• Guarantee successful transfer of customer accounts

THE PLATFORM IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

In the event of a dispute between users, we encourage resolution through direct communication. kicktide may provide assistance but is not obligated to resolve disputes. Serious disputes may require legal mediation or arbitration.

We reserve the right to suspend or terminate your account at any time for violations of these Terms of Service, fraudulent activity, or any other reason at our sole discretion.

We may update these Terms of Service from time to time. We will notify users of significant changes via email or platform notification. Continued use of the Platform after changes constitutes acceptance of the updated terms.
